The use of anti-dumping tariffs on nylon cord fabrics to withdraw their decisions

On January 8, the Indian Supreme Court revoked the government’s decision to impose anti-dumping tariffs on imported nylon cord fabrics, saying that the government had taken this decision without hearing the industry.

A working group of the Supreme Court rejected the order of the Ministry of Commerce. The working group said that after fixing the anti-dumping tariffs on nylon cord fabrics, the industry would not have the opportunity to represent them.

The Supreme Court rejected the judgment of the Customs, Customs and Service Tax Court of Appeal, and the Court of Appeal confirmed the anti-dumping duties. The Supreme Court rejected the government's order after the Auto Forum Manufacturers Association filed the application. In 2004, the Ministry of Finance expropriated temporary anti-dumping duties on nylon cord fabrics imported from China. The taxation range is from US$0.54/kg to US$0.81/kg, effective from July 26, 2004. On March 9, 2005, India adopted the final anti-dumping tariff decision. But the government’s decision was challenged by tire manufacturers who did not have the opportunity to appeal their views.
