Yesterday morning, the Shanghai No. 2 Intermediate People's Court focused on handling a series of intellectual property infringement cases. One significant case involved Adidas successfully defending its trademark against a violation. In another case, a Taobao seller faced legal consequences after being accused of selling counterfeit goods. Unfortunately, they lost the case.
At the end of last year, Bailuchi Company partnered with Zhonglian Company to market a collection of women's casual sports shoes. Adidas claimed these products infringed upon their intellectual property rights and engaged a notary office to purchase two pairs of shoes, obtaining a notary certificate as evidence. Subsequently, Adidas filed a lawsuit against Bailuchi and Zhonglian Companies at the Second Intermediate People's Court, demanding an end to the infringement, compensation for losses, and measures to mitigate the negative impact.
The court ruled that the three parallel stripes on the upper and lower parts of the sports shoes in question were nearly identical to Adidas' trademark. Bailuchi Company used this mark without permission, constituting an act of infringement. As a sports goods distributor, Zhonglian Company failed to adequately verify the authenticity of the products they sold, which also amounted to infringement. The court upheld the initial ruling.
In another case dating back to April 2007, Zhu Jingjing, who operated the "Lijia Small Shop" on Taobao, openly sold counterfeit luxury items like "LV," "GUCCI," "CHANEL," and "DIOR." By March of this year, authorities discovered 593 counterfeit designer bags in Zhu's rented accommodation. Consequently, Zhu was sentenced to 10 months in prison, fined 5,000 yuan, and ordered to forfeit the fake goods.
Following the initial verdict, Zhu appealed to the Shanghai No. 2 Intermediate People's Court, arguing that his actions constituted a meritorious crime disclosure warranting a lighter sentence. However, the appellate court dismissed his appeal, maintaining the original judgment. These rulings underscore the seriousness with which Chinese courts treat intellectual property violations and counterfeit goods sales.
